Three Nordland rules to settle before design

  1. The Nordland rule

    One island, one aquifer

    Jefferson County's critical areas code names Marrowstone Island as a sole source aquifer and a high risk seawater intrusion protection zone. Because the island is served by public water, a project there must show proof of a connection to the public supply, and new development on the island is expected to soak all of its stormwater into the ground on site unless that would destabilize an unstable slope.

  2. The Nordland rule

    The septic check that rides with a permit

    Under a Jefferson County Board of Health policy, applying for a building permit triggers an evaluation of the house's existing septic system, and lots of a quarter acre or less, or within 200 feet of a shoreline, get the closer look. Reroofing, new windows and interior remodels that add no plumbing and no bedrooms are excused, but adding a bedroom requires a system and reserve area that meet current code.

  3. The Nordland rule

    Saltwater on every side

    On marine shores such as Mystery Bay and Kilisut Harbor, the county Shoreline Master Program keeps a buffer of at least 150 feet from the ordinary high water mark, with a 10 foot building setback behind it. When a permit or exemption request covers land within 500 feet of a known or probable historic, archaeological or cultural site, the county notifies the tribes and the state historic preservation office and asks for a cultural resource site assessment before ground is disturbed.

How a Nordland permit is filed

Nordland has no town hall, so building permits come from Jefferson County's Department of Community Development. The county takes applications only by appointment, booked online, and every document has to be uploaded to its electronic file share before that appointment. Decks, demolition, reroofing and mechanical work each have their own submission type.

For work that disturbs ground, the county asks for a Site Development Review first. It looks at the lot's critical areas, road setbacks and permit needs, and it confirms the parcel is a legal lot of record. The submittal checklist then asks for proof of potable water, which for a public system means a Water Availability Notification signed by the water purveyor, plus a current septic inspection, a stormwater worksheet, and for a remodel a floor plan of the house before and after with every room labeled.

Why island water shapes a remodel

Seawater intrusion happens when heavy pumping or reduced recharge lets salt water push into a coastal aquifer. The county code counts every island as part of its coastal protection zone, and it names Marrowstone Island specifically as a sole source aquifer with documented seawater intrusion. Where a well has tested above 200 milligrams of chloride per liter, the land within 1,000 feet is a high risk zone.

Those rules explain several island requirements. A building permit here relies on the public water connection for its proof of potable water. New lots may be created on the island only when each one gets a public water connection and every existing well on the site is decommissioned. The same code asks new development on Marrowstone to infiltrate its stormwater on the lot, and a report can support an exception where that would put an unstable slope at risk.

Septic systems and Mystery Bay

Where a house treats its wastewater on site, the county ties that system to any building permit. Its evaluation of existing systems ranges from an operational check of the tank to a full assessment that locates the drainfield and measures its size. The stricter tier applies on small lots and near the water, and any faults found must be corrected before the permit receives final sign off. A permit that enlarges the footprint on a property with no designated reserve drainfield area needs one designated first.

The care reaches past the property line. Mystery Bay, on the island's west side, is a commercial and tribal shellfish growing area that the state Department of Health classifies as Approved and Conditionally Approved, with the conditional part managed under a boat management plan that agencies, tribes, growers, boaters and island residents wrote together in 2010.

Building near Kilisut Harbor and Mystery Bay

Every use and development along the county's shorelines, including work that needs no shoreline permit, has to keep the shoreline's ecological functions intact. Inside the 150 foot marine buffer the county expects native vegetation to stay, though it allows an area of active use of up to 20 percent of the buffer or 15 feet of frontage, whichever is greater, where that avoids sensitive habitat.

A boathouse for a single-family home may sit in the buffer without a variance if it stays under 300 square feet and 15 feet in height, faces the water and is recorded on title as storage only, never a dwelling. If anything of historic or cultural interest turns up during digging near the shore, the code requires work to stop and the county, the state and the affected tribes to be notified.

ADUs on Marrowstone Island

Jefferson County allows one accessory dwelling unit on a legal lot that already has a single-family house, capped at 1,250 square feet of gross floor area, and an existing outbuilding may be converted or enlarged to hold it. The owner has to live on the property, in either unit, and the ADU needs its own certificate of occupancy posted inside.

The front of the house may keep only one exterior entrance, while each unit still needs its own exit to the outside. Before the ADU permit is issued the county wants proof of potable water and a septic approval from environmental health, so on the island both questions are answered early. A travel trailer or recreational vehicle never counts as an ADU.

Island homes and what they need

Nordland is a small place: Jefferson County's comprehensive plan classes it as a convenience crossroad, a single commercial property at a historic crossroads, with a general store serving islanders and visitors. Islanders drew up their own Marrowstone Community Development Plan in 1978, and its goals were folded into the county's 1998 comprehensive plan.

The Census Bureau does not publish figures for Nordland itself, so we rely on Jefferson County as a whole. Its 2020 to 2024 American Community Survey puts the median home's build year at 1988, with close to half of all homes built across the 1970s, 1980s and 1990s. About four in five are detached houses, about 79 percent of occupied homes are lived in by their owners, and roughly 1,860 homes are kept for seasonal or occasional use.

Houses from those decades usually want their kitchens, baths, windows and insulation looked at in one pass, and every part of that scope is priced line by line in writing before work begins.

Who issues building permits in Nordland?

Jefferson County. Nordland is an unincorporated community on Marrowstone Island, so the county's Department of Community Development takes the application at a scheduled appointment, with every document uploaded to its file share beforehand. Do I need a well test to remodel on Marrowstone Island?
