How a Mill Creek home renovation gets permitted

Building, mechanical and plumbing permits are issued by the building division of the City of Mill Creek, which also reviews plans and inspects every phase of construction. Applications are made online through OpenGov, the permit service the city uses.

The Community Development and Planning permit counter takes walk-ins Monday through Thursday from 9 a.m. to noon and sees people by appointment on those afternoons, and a pre-application consultation with staff can be booked. Once work is underway, an inspection requested before 3:30 p.m. is scheduled for the next business day.

The city does not publish plan review times, so your start date is set after the city has responded to the application.

Streams, slopes and critical areas

Chapter 18.06 of the municipal code covers five kinds of critical area: wetlands, fish and wildlife habitat conservation areas, critical aquifer recharge areas, geologically hazardous areas and frequently flooded areas. The city updated its geologic hazard rules in 2026 under Ordinance 2026-945.

The city's environmental review of that update lists Penny Creek, North Creek, Tambark Creek, Nickel Creek, Mill Creek and Sitka Creek, plus Thomas Lake, which drains into Penny Creek. FEMA maps North Creek as a Zone A flood hazard area. Mill Creek has no shoreline master program of its own approved by the state Department of Ecology.

Where work does alter a geologically hazardous area or its buffer, a Washington licensed engineer or geologist must certify it as safe as designed.

ADUs and garage conversions

Where the only principal dwelling on a lot is a single house, Mill Creek allows two accessory dwelling units. Each must have between 400 and 1,000 square feet of gross floor area, counting basements and attics but not a garage.

An ADU can go into an existing structure, a detached garage for example, even when that structure does not meet setback or lot coverage rules. The application also needs a letter from the local water and sewer district confirming the supply and the sewer can take the extra unit.

What Mill Creek houses are like

Mill Creek is a young city by Puget Sound standards: the median home was built in 1995, and close to half of all homes date from 1980 to 1999, according to the Census Bureau's 2020 to 2024 American Community Survey. Only about 15 percent were built before 1980.

About half of the housing is detached single-family, and roughly a third sits in buildings of 10 or more units, so condo kitchens and bathrooms matter here as much as houses do. In a house from the 1980s or 1990s, the original cabinets, tile and decking are often what gets replaced, and we price that scope in writing before work begins.

Which Mill Creek remodels need a permit?

Any job that installs, alters, replaces or moves a building, electrical, mechanical or plumbing system, according to the city. Painting and new finishes usually do not; moving a sink, adding circuits or taking out a wall usually do. Building, mechanical and plumbing permits are applied for through OpenGov, and we prepare and file them for you.

How do I find out if my lot is on a steep slope or near a creek?

Mill Creek's code names three map sources: the critical area maps in the comprehensive plan, the city's online map portal and the state Department of Natural Resources Geologic Information Portal. They are guidance, not a final designation, so a lot near Penny Creek, North Creek or another ravine may still need a critical area report before design is settled.

Can I turn my detached garage into an ADU in Mill Creek?

Yes, in most cases. Mill Creek code lets an ADU go into an existing structure such as a detached garage even if it does not meet setback or lot coverage rules. It must still have 400 to 1,000 square feet of gross floor area, and the water and sewer district has to confirm capacity.

Does a new fence around my deck or yard need a permit?

Yes. Mill Creek requires a permit for every permanent fence, residential fences must be ornamental metal, wood, masonry or a mix of those, and none may stand in a roadway buffer. If the fence or a new deck would sit in a property buffer, the director reviews it first.

How soon does the city inspect once work starts?

Usually the next business day. The building division books an inspection requested before 3:30 p.m. for the next business day, and one requested after 3:30 p.m. is scheduled for the following business day.
