Three Vader rules to settle before a plan is drawn

  1. The Vader rule

    Olequa Creek and its 200 foot band

    Olequa Creek is the one shoreline the city's Shoreline Master Program regulates. Its jurisdiction reaches 200 feet landward of the ordinary high water mark, or further where floodways, 200 feet of floodplain beyond them or associated wetlands extend. Inside that area the creek's habitat buffer is 200 feet, no more than 15 percent of the vegetated buffer may be cleared, and native trees over 4 inches in diameter at breast height stay. An existing house that does not meet those lines may grow only upward or on the side farthest from the water, with a shoreline conditional use permit.

  2. The Vader rule

    One foot over the base flood

    The city treats the floodway and the 100-year floodplain on FEMA's Flood Insurance Rate Map as frequently flooded areas. Homes there may be built or altered as the zone allows, but the first habitable floor must be elevated or floodproofed to one foot above the base flood elevation, and no development is allowed in the floodway itself. The comprehensive plan notes that McMurphy Creek has a wider 100-year floodplain just east of the railroad tracks than Olequa Creek does inside the city.

  3. The Vader rule

    A packet the city takes only when complete

    Vader's residential permit packets, updated December 2024, state that incomplete applications will not be accepted. Each needs a Permission to Enter form, a current Lewis County Assessor's map, and a site plan showing setbacks in feet, driveways, wells and features such as ravines, seasonal creeks and wetlands. Plans go in as one electronic set or two paper sets, every plan with an engineer's stamp, fees are due when the application is handed in, and a site inspection comes before construction starts.

How a Vader permit moves

Vader runs its own Community Development Department, with a contract building official and contract planning and engineering help. Applications are printed, filled in by hand and either dropped off at City Hall or emailed to the city's building and planning inbox, and the application fees are paid when the packet goes in.

Inspections are booked by phone with at least 24 hours of notice. The city's inspection card runs from footings and foundation through framing, insulation and sheetrock to a final, and the signed final on that card serves as the certificate of occupancy. A residential plumbing permit includes up to two inspections, with trip fees for any after that, and the remodel packet asks for a licensed plumbing contractor.

Smaller jobs that need no building permit still have a form. The Property Improvement Notification lets the city confirm that the work meets its zoning and development standards before anything is built.

Olequa Creek, McMurphy Creek and the buffers

Olequa Creek runs north to south along the city's western edge, then turns east toward the Cowlitz River. The comprehensive plan lists it as a Type 1, fish-bearing stream with fall Chinook, coho and winter steelhead, and McMurphy Creek, which enters it from the northeast, as a Type 3 stream.

Outside the shoreline area the critical areas code sets riparian buffers by stream type: 250 feet for Types 1 and 2, 200 feet for a Type 3 stream 5 to 20 feet wide, and 150 feet for smaller streams. Inside the Olequa shoreline, the Shoreline Master Program sets the creek's buffer at 200 feet, and in its urban conservancy environment a single-family lot is capped at 30 percent impervious surface with a 35 foot height limit.

The city's shoreline inventory counted about 6,900 feet of creek frontage and 43 acres in shoreline jurisdiction, with some of the homes along it dating back to the early 1900s. For an owner there, a deck, an addition or new paving is measured against the creek first and the zoning setbacks second.

Slopes, silt soils and Mount St. Helens

Vader's code counts as landslide hazard ground any slope of 30 percent or more, and any slope of 15 percent or more that also has impermeable subsoil or springs and seeps between November and February. On a site like that, a geotechnical report by an engineer or geologist goes in with the building application, certifying that the project will not raise the risk.

The comprehensive plan describes slopes of 15 to 30 percent in the northeast part of town, easing to nearly flat ground along Olequa Creek in the south, on mostly Klaber and Olequa silt loam soils.

The code also places the whole city inside a volcanic hazard area tied to Mount St. Helens. The threats it names are ashfall and a mudflow on the Cowlitz River damaging the water intake, and it allows every use the zoning permits there. When a site does need critical area review, the code runs it on the same timeline as the permit, or 120 days, whichever is shorter.

Remodeling inside the existing footprint

Many Vader remodels stay inside the walls of the house, and the city has a path for that. Its Critical Areas Permit Exemption Request lists construction and modifications to existing structures that do not increase the footprint among the activities that can be exempted. The request goes to the Community Development Director in writing, and an approved exemption is kept on file with the department.

An exemption is not permission to damage a creek buffer or wetland. The form says any incidental harm that is not a necessary result of the work must be restored at the owner's expense, so staging, debris and equipment are kept clear of buffers too.

Accessory dwelling units in Vader

The zoning code allows an accessory dwelling unit in the R-1, R-2 and R-3 zones, and on a commercial lot that already holds a single-family home, and it requires the unit to connect to public sewer and water, either on its own line or through the main house.

The city's ADU Supplemental Form, updated December 2024, covers attached additions, new detached units, conversions of existing outbuildings and interior conversions of a floor, basement or garage. Every ADU needs its own locking entrance. A detached unit sits 10 feet from the house or has a fire-rated wall facing it, an attached unit is separated by a tested one-hour assembly rated for sound, and both homes get smoke and carbon monoxide alarms.

The form also warns that the electrical service may need an upgrade at the transformer, and it directs owners to Lewis County PUD to confirm capacity and overhead line clearance. Turning an unheated basement or garage into living space has to meet the energy code, including insulation upgrades.

One figure needs checking: the form caps an ADU at 800 square feet or half the main house, while the code text we read sets 850 square feet for a detached unit. We confirm the size limit with the city before design.

What Vader houses are built from

Vader began as Little Falls, a railroad town of the 1870s, and its comprehensive plan describes a mix of Victorian houses, newer homes and manufactured homes on the old town plat. One of those Victorians, the Ben Olson House, is on the National Register of Historic Places.

The Census Bureau's 2020 to 2024 American Community Survey counts about 259 homes in the city, roughly 38 percent of them built in 1939 or earlier. About seven in ten are detached houses and about one in five is a mobile home. For a city this small the margins are wide, but the old core is plain to see.

Opening walls in houses that old tends to expose older wiring, plumbing and insulation, and we name those possibilities in the itemized price. Where a project includes demolition, the city also asks for a Southwest Clean Air Agency demolition permit showing that any asbestos has been removed, so testing is scheduled before walls come down.

Vader remodeling questions, answered

Do I need a permit to remodel a kitchen or bathroom in Vader?

In most cases, once fixtures, venting or layout change. The city's permit forms list kitchen sinks, dishwashers, showers, bathtubs and water heaters as plumbing items and range vents and bath fans as mechanical ones. We work out which permits your plan needs before the price is final.

How do I apply for a building permit in Vader?

Print the city's packet, complete it by hand and hand it in at City Hall or email it to the building and planning inbox, with fees paid at submittal. Incomplete packets are not accepted, so on our projects we prepare the drawings and assemble the whole packet first.

Can I add an ADU to my Vader property?

Often, yes. The zoning code allows one in the R-1, R-2 and R-3 zones and on a commercial lot with an existing house, connected to public sewer and water, and the city's ADU form adds fire separation, entrance and electrical requirements that shape the design.

My lot backs onto Olequa Creek. What changes?

A second set of rules. The Shoreline Master Program reaches 200 feet from the creek's high water mark, keeps native trees in the buffer and lets an existing house there grow only upward or away from the water, with a shoreline conditional use permit.

What if my project does not need a building permit?

The city still wants to hear about it. Its Property Improvement Notification form lets staff confirm that work without a building permit meets zoning and development standards, and interior work that keeps the same footprint can request a critical areas exemption in writing.

What will a home remodel in Vader cost?
